Boundary Disputes

Providing advice, drafting and representation for any issues concerning boundaries or lines of junction between properties and land, or where there has been an unlawful trespass.

If you have an issue that is not resolved then it may make your property difficult to sell or devalue your home. As this is often the most valuable asset we own, do not ignore or delay in seeking professional help if not resolved between you as neighbours.

Party Wall Disputes and Appeals

A large part of our work is dealing with Party Wall Appeals or cases which have fallen short in terms of appointed surveyors and disputes, surveyors often having acted outside of their given jurisdiction.

A ‘Party Wall Surveyor’, who is statutorily appointed by a ‘Building Owner’ or ‘Appointing Owner’ does not have to be qualified as a ‘surveyor’ and appeals or claims are often unfortunately necessary. If you are negatively affected by an Award, and you believe you have grounds to appeal, do not delay; the law only provides for an appeal strictly within 14 days of service upon you.

Easements and Property Rights

Rights over and along property are part and parcel of our areas of practice. We advise and represent on cases that deal with issues such as rights of way, rights of light and other rights over and through property, such as support and drainage. We also deal with cases where there are complaints of Trespass and Nuisance, or damage to your property/land.

Where there has not been resolution, then allow us to act on your behalf. We find that in most cases a Letter Before Claim carefully considered and drafted will result in resolution before disproportionate costs are incurred by either party to the dispute.
